Hongkong and working as usual in the shop caused him to regard

Mr. F. Heermann as still in charge of the business and his own

appointment as being in abeyance pending the daily expected

departure of his employer. In fact he always looked to Mr.

7. Heermann for instructions, vide our letter of 11/11/14 in which

we reprimanded him for advancing each to Mr and Mrs Heermann,

his explanation being he still regarded Mr. F. Heermann as the

owner of the business,

It appears from the firm's letter book that all

correspondence with the Bank (apart from the letter of the 14th

August above mentioned) was signed by Hr. Penning in his own name under

the stamped signature of Chs. J. Gaupp & Ce between 17th and 26th

August and afterwards as per procuration Cha. J. Haupp & Co.

A.L. Penning until 28th Oct. 14. It will be noted there is

no mention of the word "Manager".

To confirm this contention, an important letter was

signed by Mr. P. Hearmann on 31st August to Messrs Mappin & Webb Ltd.,

London, outlining some finance arrangements, intimating business

was progressing as usual and informing them that the Firm had

given Mr. Panning a power of procuration as he had been with the firm

for some time and asking them to regard his signature as their own.

In this letter it states the Firm is unable to remit money by Draft

but assures them that, iổ they will draw, all bills will be duly met.

A similar letter to Kesers Imray, Laurie, Noris & Wilson was written

on same date but not sent.

On 25th September letters were written to Kesure V.F.

Stanley & Co Ltd., A. Haswell & Sons, Happin & Webb Ltd, Whitehorn
